These Terms of Use ("Terms") govern your access to and use of get-myautoquote.com and the telephone number published on it (together, the "Site"), owned and operated by Seagulls Media Solutions LLC under the brand name Get My Auto Quote ("we," "us," or "our"). By using the Site or calling the number on it, you agree to these Terms. If you do not agree, do not use the Site.

1. What this Site is — and what it is not

Get My Auto Quote is an advertising and referral service. We are not an insurance company, insurance agency, or insurance broker. We do not sell, solicit, or negotiate insurance, we do not issue policies, and we do not make underwriting or pricing decisions. When you call the number on the Site, you are connected with a licensed insurance agent or with one of our marketing partners. We may be compensated for connecting you, and that compensation may vary.

Nothing on the Site is insurance advice, an offer of insurance, a binder, or a promise of coverage. No coverage is bound and no policy is in force unless and until an insurer issues it.

2. No guarantee of rates, coverage, or savings

Any reference to comparing quotes, options, or coverage describes the service, not an outcome. Eligibility, premiums, discounts, coverage options, and product availability are determined solely by insurers and vary by state, carrier, and individual circumstances. Not all products are available in all states. We do not guarantee that any quote, rate, discount, coverage, or savings will be available to you.

3. Eligibility

The Site is intended for residents of the United States who are at least 18 years old and able to form a binding contract. Do not use the Site if you do not meet these requirements.

4. Telephone calls and recording

Calls placed to the number on the Site are routed through a call-tracking provider and may be recorded or monitored for quality assurance and training purposes. By calling, you consent to that recording and monitoring, and you consent to being contacted at the number you call from in connection with your inquiry. Standard message and data rates from your carrier may apply. You may withdraw consent to further contact at any time by telling the caller or by emailing privacy@get-myautoquote.com.

5. Acceptable use

You agree not to use the Site to submit false or misleading information; to access it by automated means, scrape it, or place artificial or fraudulent calls; to interfere with its operation or security; to reverse engineer any part of it; or to use it for any unlawful purpose or in violation of any applicable law, including telemarketing and consumer-protection laws.

6. Intellectual property

The Site, including its text, layout, graphics, and code, is owned by us or our licensors and is protected by intellectual property laws. You may view and print pages for your own personal, non-commercial use. Any other reproduction, distribution, or modification requires our written permission. Third-party names and marks that may appear are the property of their respective owners and their use does not imply affiliation or endorsement.

7. Third-party services and links

The Site relies on third parties — including hosting, call routing, and advertising providers — and may link to sites we do not control. We are not responsible for the content, products, services, or practices of any third party, including any licensed agent, marketing partner, or insurer you are connected with. Your dealings with them are solely between you and them.

8. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CALL WILL BE CONNECTED.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN OF THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify and hold harmless Seagulls Media Solutions LLC and its officers, members, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

11. Governing law and dispute resolution

Please read this section carefully. It affects how disputes between you and us are resolved, and it limits your ability to bring a claim in court or as part of a class action.

Informal resolution first. If you have a problem, contact us at support@get-myautoquote.com before starting any formal proceeding. Most issues are resolved this way, and we ask that you give us thirty (30) days to try.

Governing law. These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement below.

Binding arbitration. If a dispute is not resolved informally, you and we agree that it will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted by a single arbitrator, and may take place by telephone, by video, on written submissions, or in the county where you reside, at your election. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.

Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property rights. Nothing in this section prevents you from reporting a concern to any federal, state, or local government agency, and nothing waives any right that cannot be waived under applicable law.

Class action waiver. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this class action waiver is found unenforceable as to a particular claim, that claim — and only that claim — will be severed from the arbitration and brought in court.

Your right to opt out. You may reject this arbitration agreement and class action waiver by emailing support@get-myautoquote.com with your name, the telephone number you called from, and a clear statement that you opt out of arbitration, within thirty (30) days of first using the Site. Opting out affects nothing else in these Terms, and we will not hold it against you in any way.

12. Changes and termination

We may modify these Terms at any time by posting the updated version here and changing the "Effective" date. Continued use of the Site after a change constitutes acceptance. We may modify, suspend, or discontinue the Site, in whole or in part, at any time.

13. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site.
